Does your business solar carport need planning permission?

Some business solar carports in England can use permitted development rights, subject to restrictions and a prior-approval application. Class OA excludes development exceeding 4 metres in height [S1]. Your design, neighbouring homes, heritage setting and lawful parking use all matter. Scotland has a separate regime; check the rules for your nation before commissioning foundations. Checked October 2026.

Do commercial solar carports need planning permission?

In England, Class OA provides a permitted development route for qualifying solar canopies over lawful non-domestic off-street parking [S1]. It is a conditional route. Ask your planning adviser to establish which permission you can rely on before you order the structure or arrange groundworks.

The government’s policy explanation confirms a prior-approval process addressing siting, design, appearance and glare [S2]. Avoid treating a supplier’s statement that permission is unnecessary as your complete planning record. Request the relevant drawings, assessment and written council outcome for the design you intend to build.

This guide focuses on a business car park. Household outbuilding rules are a different starting point. If your pub, farm shop or hotel shares land with a home, ask your adviser to identify the relevant boundaries and uses before deciding which route fits. Check the legal position with your solicitor where title or use is uncertain.

How high can a solar canopy be under permitted development?

Class OA excludes any part of the development exceeding 4 metres above ground level or lying within 10 metres of the curtilage of a dwellinghouse or block of flats [S1]. Those are eligibility limits, not a recommended vehicle-clearance design. Have the designer show both the overall height and the clearance beneath the structure.

Check on your drawing Evidence to request
Overall height Ground levels and highest point of proposed development
Neighbouring residential curtilage Measured separation to the relevant boundary
Parking status Evidence of lawful existing use
Vehicle movements Swept paths, delivery access and emergency access
Existing buried infrastructure Survey informing foundations and cable routes

The first planning limits come from Class OA [S1]. The remaining evidence requests are practical survey questions. Do not draw the entire canopy first and leave the supports for later. Ask for a layout showing columns, protective barriers, drainage, accessible routes and any chargers. Compare the loss of usable parking space with your trading needs before agreeing a funding contract.

What does the prior-approval application need to address?

Government guidance identifies the canopy’s siting, design and external appearance, particularly glare affecting occupiers of neighbouring premises. It also explains the appearance assessment for protected article 2(3) land [S2]. Ask the planning adviser which assessments and drawings are necessary for your proposal.

Bring photographs, parking plans, nearby windows and roads, boundary information and your proposed panel layout to the initial discussion. Request a glare assessment where the adviser identifies a need. Keep each submission version aligned with the construction drawings so a later change does not quietly depart from the assessed design.

Ask the council to confirm the application route, required information and applicable decision process. Do not commit to an installation start based solely on a headline processing estimate. Have your adviser identify what must happen before works begin and what conditions need to be recorded in the contractor’s programme.

Can you put panels on an existing carport or enclose the sides?

The Class OA definition concerns a canopy installed with solar photovoltaic (PV) or solar thermal equipment, open on all sides, or on three sides when adjoining a building [S1]. Adding walls or changing the use deserves a fresh assessment; do not assume the original canopy route covers a substantially different structure.

For an existing carport, give the adviser its original permissions and give the structural engineer its drawings, condition records and proposed panel loading. Ask whether an alternative solar equipment right is relevant. Keep planning assessment and engineering suitability as separate deliverables, with responsibility for each named in the quotation.

Solar PV generates electricity from sunlight. If panels supply chargers or your building, ask for an electrical diagram showing the connection, metering and control arrangement. Your distribution network operator (DNO) manages the local network; its generation connection process sits alongside the planning work [S5]. Read the grid connection guide before assuming all output can be exported.

Are solar carport planning rules the same across the UK?

No single English class establishes permission throughout the UK. Scotland’s official guidance describes Class 9M, with a canopy height limit of 4 metres and separate limits for associated development [S4]. Ask a Scottish planning adviser to apply that guidance to the actual location and design.

For Wales or Northern Ireland, obtain confirmation from the relevant planning authority or adviser before relying on a permitted development claim. This guide does not supply an unverified national exemption for either. Give every bidder the same planning assumptions so you can compare proposals consistently across your sites.

What should the project budget and contract include?

The government’s car-park solar call for evidence discusses planning policy [S3]. It is not permission for your particular site; base the project programme on your own assessed route and written decisions.

Request separate allowances for planning work, surveys, foundations, drainage, electrical works and disruption to trading. The solar carport cost guide helps structure the comparison. No standard application fee or installed price is assumed here.

Ask who pays for redesign if the council requires a different layout, and who carries abortive costs if the project does not proceed. Include landlord and lender consent, roof or land rights, liability, business rates allocation, maintenance access and end-of-term removal in the contract review. Fully funded equipment still needs your scrutiny of the property commitment; compare a solar PPA with buying before signing.

What should you do next?

Prepare your site plan, ownership details, parking use and intended electrical layout. Discuss accessible charging early so the structure and bays are designed together.

Common questions

Does England's solar canopy right cover a new car park on a field?

Class OA concerns an area lawfully used for non-domestic off-street parking [S1]. Ask your planning adviser to establish the parking use before assessing a canopy on previously unused land.

Is a conservation area automatically excluded in England?

Class OA includes an appearance assessment for article 2(3) land [S1]. Do not assume exclusion or consent; ask the council to check the designation, restrictions and prior-approval requirements for your plot.

Can a listed hotel's car park use the same route?

Class OA excludes development within a listed building's curtilage [S1]. Give your planning adviser the listing and site boundary so the appropriate planning and heritage consents can be assessed.

Is the government car-park solar consultation a permission to build?

No site-specific permission follows from a call for evidence. The government paper discusses solar canopy policy and planning [S3]; establish your route against the applicable rules and council decision.

Does planning approval also settle electricity export?

Generation connection arrangements need separate assessment with your distribution network operator [S5]. Send the electrical design, existing generation and proposed export limit alongside the planning work.
